Scope of These Terms and Seller Identity
These Terms and Conditions of Sale ("Terms") govern the distance sale of products and services offered through the Lecco Pesca website. By placing an order on the website, you confirm that you have read, understood, and accepted these Terms in full, which form an integral part of the sales contract concluded with Lecco Pesca. These Terms apply to all sales made through the website, whether to consumers or, where compatible, to buyers acting for professional purposes.
Products and Services
Lecco Pesca sells, through its website, fishing rods, reels, lines, lures and artificial baits, technical clothing and accessories for fishing, as well as equipment for mushroom foraging. The website also offers a rod repair and rebinding service.
Product images and descriptions on the site are for illustrative purposes and are prepared with care to reflect product features as accurately as possible; however, for technical reasons, such as differences in how colours are displayed on different screens, they may not exactly match the actual product. The essential characteristics of each product are set out on its product page. In case of any discrepancy between an image and its written description, the written description prevails.
Account Registration and Ordering Process
Browsing the website and the product catalogue does not require registration. To complete an order, you may create a personal account or check out as a guest, providing the information needed to process your order.
The website offers two ordering channels: (a) direct purchase, where you select products, add them to your cart, and complete immediate payment through the Stripe payment gateway at the time of ordering; or (b) a quote or custom order request, for example for the rod repair and rebinding service or for orders that require a preliminary availability check, where you submit a request through the relevant form and our staff review and confirm it manually before sending you a secure payment link to finalise the order.
In both cases, before confirming your order you can review a summary of the selected products, the total price including shipping costs, and your details, and correct any input errors.
Prices and Payment
All prices shown on the website are in Euro (EUR) and, where applicable, are inclusive of VAT at the rate in force at the time of the order. Shipping costs, calculated according to the zones described in the following section, are shown separately before you confirm your order.
Payments are processed securely through our payment provider, Stripe, which supports major credit and debit cards; additional payment methods, such as PayPal, may be made available in the future. Lecco Pesca never has access to the full details of the payment instruments used, which are processed exclusively by the payment provider.
The sales contract is considered concluded at the moment payment is successfully confirmed by the payment provider, or, in the case of quote-based orders, at the moment you complete payment through the secure link sent by Lecco Pesca following manual confirmation of your order by our staff.
Shipping and Delivery
Shipments are organised into three flat-rate zones based on destination: Italy, the European Union, and the rest of the world. The applicable shipping cost is shown before you confirm your order and is determined by destination zone; these costs are not calculated through real-time carrier integration but are set by Lecco Pesca based on reasonable estimates.
Delivery times shown on the website are indicative and may vary depending on destination, product availability, and exceptional circumstances. Unless otherwise agreed, Lecco Pesca will ship orders within a reasonable time from conclusion of the contract.
Risk of loss or damage to the products passes to a consumer at the moment they, or a third party designated by them other than the carrier, physically take possession of the goods. For buyers acting for professional purposes, risk passes upon delivery of the goods to the carrier, unless otherwise agreed.
Legal Warranty of Conformity
Products sold by Lecco Pesca to consumers are covered by the legal warranty of conformity provided for by the EU Consumer Rights and Sale of Goods Directives, as implemented in Italy through Articles 128 et seq. of the Consumer Code (Codice del Consumo, Legislative Decree 206/2005). The warranty runs for 24 months from delivery and covers defects of conformity that existed at the time of delivery.
In the event of a defect of conformity, the consumer is entitled, under the conditions set by law, to free repair or replacement of the goods, and, where this is not possible or would be disproportionately costly, to a price reduction or termination of the contract. To exercise this warranty, please contact Lecco Pesca at leccopesca@gmail.com, describing the defect and enclosing proof of purchase.
Limitation of Liability
To the extent permitted by applicable law, Lecco Pesca's liability for damages arising from performance of the contract is limited to direct and foreseeable damages at the time the contract was concluded, excluding indirect or consequential losses. Nothing in these Terms excludes or limits Lecco Pesca's liability for wilful misconduct or gross negligence, for death or personal injury caused by negligence, or in any other case where liability cannot be excluded or limited under applicable law.
Lecco Pesca is not liable for delays or failures to perform caused by events of force majeure or exceptional circumstances reasonably beyond its control.
Governing Law, Jurisdiction and Dispute Resolution
These Terms are governed by Italian law. Where the customer is a consumer resident in another EU member state, the choice of Italian law does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of residence, where applicable.
For disputes concerning the interpretation and performance of these Terms, jurisdiction over consumers lies with the courts of the consumer's place of residence or domicile, where located in Italy; for buyers acting for professional purposes, the courts of Parma, Italy, have exclusive jurisdiction.
As an alternative to court proceedings, consumers resident in the European Union may use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr, to seek out-of-court settlement of disputes relating to online purchases.
Changes to These Terms and Governing Language
Lecco Pesca reserves the right to amend these Terms at any time, for example to reflect changes in the law or in our business operations. Any changes will be published on the website with an updated date and will not apply to orders already confirmed before the changes take effect. We recommend that users periodically review the current version of these Terms.
These Terms are drafted in Italian and translated into other languages for the convenience of users. In the event of any discrepancy or conflict between the Italian version and a translated version, the Italian text shall prevail.
