Right of Withdrawal

If you are a consumer purchasing products through the Lecco Pesca website, you have the right to withdraw from a distance sales contract within 14 calendar days, without giving any reason and without penalty, subject to the exclusions described later in this notice.

The 14-day period runs from the day on which you, or a third party other than the carrier designated by you, take physical possession of the goods. Where an order consists of multiple goods delivered separately, the period runs from the day you receive the last good, lot, or piece.

This right of withdrawal applies only to consumers, meaning natural persons who purchase goods or services for purposes outside their trade, business, or profession. It does not apply to purchases made by buyers acting for business, commercial, or professional purposes.

To exercise your right of withdrawal, you must inform Lecco Pesca of your decision by means of a clear and unambiguous statement, sent before the 14-day period expires, either by email to leccopesca@gmail.com or by post to Via delle Basse 1, 43044 Collecchio (PR), Italy.

You may, if you wish, use the model withdrawal form set out in the following section, but this is not compulsory: any written statement clearly expressing your decision to withdraw from the contract, identifying the relevant order, is sufficient. Lecco Pesca will promptly acknowledge receipt of your withdrawal notice, for example by email.

Complete and return this form only if you wish to withdraw from the contract; using it is entirely optional.

If you withdraw validly, Lecco Pesca will reimburse all payments received from you, including the standard delivery costs you paid, excluding any additional costs resulting from your choice of a delivery type other than the least expensive standard delivery we offer, without undue delay and in any event within 14 days from the day we are informed of your decision to withdraw.

The reimbursement will be made using the same means of payment you used for the original transaction, unless you expressly agree otherwise; in any event, you will not incur any fees as a result of the reimbursement. Lecco Pesca may withhold reimbursement until the goods have been received back, or until you have supplied evidence of having returned them, whichever is earlier.

If you withdraw from the contract, you must return the goods to Lecco Pesca without undue delay and in any event within 14 days from the day you communicated your decision to withdraw, sending them to Via delle Basse 1, 43044 Collecchio (PR), Italy, unless Lecco Pesca provides different return instructions when acknowledging your withdrawal.

The deadline is met if you send the goods back before the 14-day period expires. You will bear the direct cost of returning the goods, unless Lecco Pesca has agreed to bear those costs or failed to properly inform you that you would have to bear them.

You are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning. We therefore recommend handling products carefully, not using them, and, where possible, keeping the original packaging and labels until the withdrawal period has expired.

Where diminished value results from handling the goods beyond what is necessary to check their nature and characteristics, Lecco Pesca reserves the right to deduct the corresponding amount from the reimbursement due, providing you with a reasoned explanation.

In accordance with applicable EU and Italian consumer law, the right of withdrawal does not apply, among other cases, to: goods made to your specifications or clearly personalised; sealed goods which are not suitable for return for health protection or hygiene reasons, if unsealed after delivery; and service contracts, such as the rod repair and rebinding service, that have been fully performed where performance began with your express agreement and your acknowledgement that you would lose the right of withdrawal once the service was completed.

For custom repair or rebinding services, before starting work Lecco Pesca asks you to expressly consent to immediate performance of the service and to acknowledge that, once the service has been fully carried out, the right of withdrawal will no longer apply. If the work has not yet been completed, you may still withdraw within the ordinary time limits, though you may be required to pay an amount proportionate to the part of the service already provided up to the time you communicate your withdrawal.

The right of withdrawal described in this notice applies to consumers only; buyers acting for business or professional purposes do not benefit from this right, unless otherwise agreed contractually.
